Site Terms for Website Visitors

These Terms of Use (“Terms”) govern your access to and use of the JobStars website and services (collectively, the “Site”) provided by JobStars USA LLC (“JobStars”). By using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, do not access or use the Site.

1. Services Provided

JobStars provides the Site and related services to you, the user (“Client” or “You”). By accessing or using the Site, you agree to these Terms. You accept the Terms by:

(a) engaging JobStars for resume writing, career coaching, or other services;
(b) using the Site in any capacity; or
(c) otherwise indicating agreement with these Terms.

If you do not agree, please discontinue use of the Site. JobStars operates the Site from multiple locations and does not guarantee the availability of services in all areas. Some services may vary by location. While JobStars endeavors to deliver all communications sent through the Site’s messaging system, delivery cannot be guaranteed.

2. Your Obligations and Conduct

By using the Site, you agree to:

(a) provide accurate, current, and complete information during registration (“Registration Data”);
(b) use your real name in all communications unless otherwise specified;
(c) maintain the security of your account credentials;
(d) promptly update your information to ensure accuracy; and
(e) refrain from using the Site if you are under the age of 13.

You are responsible for all content you upload, post, or otherwise transmit via the Site (“Content”). You agree not to post Content that:

JobStars reserves the right to edit or remove Content that violates these Terms or includes unauthorized advertisements.

You may access confidential information belonging to JobStars, including technical, contractual, and business details (“Confidential Information”). You must maintain the confidentiality of such information and not disclose it without prior written consent from JobStars.

This obligation does not apply if you can demonstrate the information:

(a) was already in your possession without confidentiality obligations;
(b) became publicly available through no fault of your own;
(c) was disclosed by a third party with authorization; or
(d) must be disclosed under law or legal order, provided you notify JobStars in advance.

4. Content Submitted to the Site

JobStars does not claim ownership of Content you submit but reserves the right to use such Content under a royalty-free, perpetual, and worldwide license. This license allows JobStars to reproduce, modify, distribute, display, and otherwise utilize the Content in any form or medium.

You warrant that you have the necessary rights to grant this license and that your submission does not violate any laws or third-party rights.

5. Indemnification

You agree to indemnify and hold JobStars, its affiliates, and representatives harmless from claims, damages, or liabilities arising from:

• your use of the Site;
• your violation of these Terms; or
• your infringement of any third-party rights.

6. General Terms

These Terms constitute the entire agreement between you and JobStars regarding the Site. Additional terms may apply when you use specific services.

If any provision is deemed invalid, the remaining provisions will remain enforceable. Any failure by JobStars to enforce a right does not constitute a waiver of that right. JobStars may seek injunctive relief for breaches causing irreparable harm.

7. Transaction Terms

By using JobStars services, you agree to pay all applicable costs, including service rates, travel fees, and cancellation fees as outlined in JobStars’ Customer Terms.

8. Third-Party Services and Communications

JobStars may offer third-party verification services. While voluntary, these services are subject to the Fair Credit Reporting Act (FCRA). JobStars is not liable for inaccuracies in third-party information or communications. You are responsible for assessing their reliability.

9. Advertisements and Promotions

JobStars may display third-party advertisements on the Site. Any interactions with these advertisers are solely between you and the advertiser. JobStars is not responsible for any loss or damage arising from such dealings.

10. Links and Third-Party Content

The Site may include third-party content or links. JobStars does not endorse or assume liability for such content. Your reliance on third-party materials is at your own risk.

11. Intellectual Property Rights

The Site’s content, including trademarks, is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission from JobStars. Unauthorized use is strictly prohibited.

12. Limitation of Liability

JobStars is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, even if JobStars has been advised of the possibility of such damages. This includes, but is not limited to:

JobStars’ total liability for any claims related to the Site is limited to the amount you paid, if any, for services during the six months prior to the claim.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Illinois without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms will first be resolved through good-faith negotiation. If the parties are unable to resolve the dispute, it will be submitted to binding arbitration under the rules of the American Arbitration Association. Arbitration will take place in Chicago, Illinois, unless otherwise agreed.

14. Force Majeure

JobStars will not be held responsible for delays or failures in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war, government actions, labor disputes, or internet service interruptions.

15. Termination

JobStars reserves the right to terminate or suspend your access to the Site at its sole discretion, without prior notice, for violations of these Terms or other conduct deemed harmful. Upon termination, your right to use the Site immediately ceases, but provisions related to intellectual property, indemnification, and limitation of liability will survive.

16. Privacy Policy

Reference your privacy policy to ensure users understand how their data is collected, stored, and used. Include a clear link or brief mention that by using the Site, users also agree to the Privacy Policy.
